Jackie was never arrested, the insurance company dropped their investigation into insurance fraud, and the case filer gave Jackie only two tickets instead of a hit and run charge due to our hard work early on in the case.
Then, we beat both of Jackie’s tickets in traffic court three months later. Now, Jackie can continue on with her life without an arrest, charge, or even a ticket on her record.
Jackie was terrified of getting in legal trouble and of spending any time in prison time for a felony charge of insurance fraud in South Florida.
Jackie had never been arrested before. She was terrified about potentially having to tell her overbearing father about the charges. Jackie also did not want a few poor choices about the same situation to ruin her future.
Jackie was driving around in Miami when she got in a car crash. She was scared and didn’t know what to do, so Jackie fled the scene.
The next day, Jackie called in the damage to her car to her insurance agency, but lied about what she had hit. The insurance company immediately figured out that Jackie was lying, and had a fraud investigator start looking into her and the crash. The investigator was able to ID Jackie from the crash, so they knew that she was at fault.
Jackie was referred to us by another attorney, so we met with her and let her explain the situation to us, and then we explained the situation from a legal standpoint.
Our main goal was to make sure that Jackie was not going to get arrested for a felony fraud charge, so we immediately filed an invocation of rights form. This meant that if anyone tried to question Jackie, she could give them the form and they would have to go through us for answers.
We had to reach out to both the fraud investigators and the police, as Jackie was being looked into for the hit and run.
As we were talking to the insurance company, we worked out a deal where Jackie would withdraw her claim and admit fault if the investigators would not send the case to the police and pursue charges. We physically went down to the insurance company with Jackie and had her admit to the false claim in person.
Once the investigation was closed by the insurance company, we worked with law enforcement and were able to convince the crash investigator to give Jackie two traffic tickets instead of charging her with a hit and run.
Now, Jackie has no arrest and no felony on her record from the incident.
