We found out Carmen’s boyfriend was calling the prosecutor non-stop pushing them to press charges against her. He wanted custody of the kid, along with child support payments. We showed the prosecutor the letter Carmen had written during the other case which, combined with the harassing phone calls, convinced the prosecutor that it was the boyfriend who was a lying nuisance. All charges against Carmen were dismissed.
Carmen was terrified of losing custody of her child. A human resources professional at a prominent company, she was also afraid of losing her job and damaging her reputation, both professionally and personally.
Carmen G. was in an abusive relationship with her boyfriend who is also the father of her child. He came over one day to see the kid, and they got into a verbal argument about how he is never there for her or his kid. They got into a physical altercation at which point Carmen called the police. When the police arrived they saw that Carmen had a gash on her forehead, but decided it was a self inflicted wound. Instead of arresting the boyfriend, they arrested Carmen and charged her with domestic violence battery. We met with Carmen on New Year’s Eve, and she hired our firm to help her.
This was an abusive relationship in which Carmen had been a victim for a long time. Her boyfriend had been arrested the year before for misdemeanor domestic violence charges, child neglect, and felony criminal mischief. At the time of that case Carmen wrote a heartfelt letter to the judge detailing all of the physical abuse she had suffered. But in the end she felt pressured and declined to prosecute. She was too worried about her baby not having a father, and felt guilty. We wanted to prove to the prosecutor that she was the real victim, not him.
